اسماعیل پیروز رئیس ائتلاف فراگیر جمعی از وكلا وحقوقدانان ایران كه دارای 21 هزار عضو حقوقدان می باشد عصر روز چهارشنبه 30 تیرماه در یك نشست صمیمی با مدیر عامل خبرگزاری ماهین نیوز از روش كانون وكلا در مواجهه با مسائل انقلاب انتقاد كرد و گفت كانون وكلا با چهل سابقه هنوز نتوانسته نشریه خود را روز آمد كند ووقتی قانون تجارت را تدوین می كرد در مقابل اعتراض به كم كاری گفته بود كه چون بودجه كم بوده كار هم كم شده است حالا چگونه می خواهد كار سنگین تنقیح قوانین را كه مجلس خود بیش از سی میلیارد ریال تصویب نموده رایگان انجام دهد؟
كانون وكلا بودجه خود را از محل درصدی از مالیات وكلا تامین می كند ولذا باید موافقت تمام اعضا را جلب كند در ثانی جزو وظائف تعریف شده آن هم نیست مگر اینكه تمام این كارها را به دانشجویان و كار آموزان واگذار كند كه در این صورت دست كمی از قانون تجارت نخواهد داشت
متن مصاحبه با اسماعيل پيروز در مورد طرح تدوين و تنقيح قوانين ومقررات كشور
س: چطور از اين طرح مطلع شديد؟
ائتلاف فراگیر جمعی از وكلا و حقوقدانان بعنوان پيشنهاد طي نامه اي در مورخه 7/2/89به رياست محترم مجلس دكتر لاريجاني تقاضاي ملاقات جهت تعامل و همكاري كميته هاي تخصصي ائتلاف با نمايندگان محترم كميسيون هاي مجلس درراستاي همكاري در لوايح و مصوبات و شيوه نامه نگارش قانون و تدوين و گرد آوري علمي قوانين را درخواست نمود. اين نامه به حجه الاسلام و المسلمين حاج آقا قرباني قائم مقام محترم معاونت قوانين مجلس شوراي اسلامي در امور تنقيح ارجاع داده شد و ايشان اعضاي ائتلاف را دعوت به مجلس نمودند. كه اين جلسه مورخه 17/3/89 برگزار شد و حاج آقا قرباني در اين جلسه طرح عظيم و ملي تدوين و تنقيح قوانين و مقررات كشور را كه براي اولين بار مطرح شده و مجلس شوراي اسلامي براي اجراي آن در تصويبنامه مورخه اسفندماه 1388 مسئوليت اجراي آن را به قائم مقام محترم معاونت قوانين مجلس شوراي اسلامي در امور تنقيح واگذار نمود و مبلغ 30 ميليارد ريال اعتبار هم براي هزينه هاي اين طرح منظور نمود .
رئیس ائتلاف فراگیر جمعی از وكلا و حقوقدانان ایران نيز در تاريخ 29/3/89 كتبا آمادگي خود را براي عضويت در همه 39 كارگروههاي پيشنهادي اين طرح به مجلس شوراي اسلامي اعلام كرد.
در مكاتبات بعدي مجلس شوراي اسلامي از ائتلاف فراگیر جمعی از وكلا و حقوقدانان خواستند كه هزينه اجزاي اين طرح را اعلام كنيم كه كليات مالي طرح را در مورخه 12/4/89 به ميزان كمتر از بودجه مصوب به صورت كارشناسي شده به حجه الاسلام والمسلمين حاج آقا دكتر قرباني قائم مقام محترم معاونت قوانين در امور تنقيح مجلس شوراي اسلامي ارسال نموديم
مجددا مجلس شوراي اسلامي اسامي سر گروه ها را از ما مطالبه كردند كه طي ليستي در 10 صفحه بالغ بر 70 نفر براي 39 كار گروه از افراد تحصيلكرده و علمي و تخصصي با درجه دكتري حقوق و عضو هيات علمي دانشگاههاي معتبر كشور در تاريخ 16/4/89به مجلس محترم اعلام نموديم
مختصري از اعضا معرفي نمائيد: مدير پروژه اين طرح آقاي دكتر علي حاجي پور معاون حقوقي و پارلماني ائتلاف و مدير طرح تدوين و تنقيح قوانين و داراي درجه دكتراي حقوق پارلماني و انتخابات از دانشگاه اكس مارسي فرانسه
جانشين مدير پروژه و مسئول كميته تدوين قوانين جناب آقاي صفر بيگ زاده داراي تاليفات حقوقي از جمله شيوه نامه نگارش قانون كه به چاپ سوم هم توسط مجلس شوراي اسلامي رسيده و يا مقاله تدوين و گردآوري علمي قوانين چاپ شده در مجله مجلس و پژوهش . كارشناس حقوقي مركز پژوهش هاي اسلامي انتخاب و به مجلس به همراه 70 نفر ديگر معرفي گرديدند كه مجلس طي نامه اي به مورخه 27/4/89 دعوت به جلسه نمود كه اين جلسه به منظور بررسي نقطه نظرات كارشناسي اجرائي در خصوص تنقيح قوانين كشور برگزار و از اينجانب دعوت بعمل آيد كه اينجانب به همراه آقاي دكتر علي حاجي پور معاونت حقوقي و جناب آقاي دكتر صفر بيگ زاده مسئول كميته تدوين و بررسي قوانين ائتلاف جناب آقاي دكتر اخوت از اعضا و رضا سليمان نژاد جمعا 5 نفر ه در جلسه شركت نموديم كه در آن جلسه متوجه شديم از كانون وكلاي دادگستري مركز ويك مجموعه حقوقي ديگر هم دعوت به عمل آمده بود . پس ازبحث و بررسي و ايراد سخن اعضا و داوطلبين اجراي طرح متاسفانه نمايندگان كانون وكلا كه از اعضا هيات مديره هم بودند بدون اينكه كليات مالي ابراز نمايند و يا متخصصين زبده و علمي براي سرگروهي به مجلس معرفي نمايند، اعلام داشتند كه كانون وكلا حاضر است اين طرح را به صورت رايگان انجام دهد. جاي سوال اينجاست كه كانون وكلا كه در خصوص موارد زير تعجب آور است.اولا: مجله كانون وكلا در زمره نخستين مجله علمي ايران است اما با وجود گذشت بيش از 40 سال كانون هنوز موفق به ارتقاء به سطح علمي پژوهشي يا حتي علمي ترويجي نشده است . ثانيا: هيچ جاي دنيا كانون وكلا پا را از حيطه صلاحيت خود فراتر نمي گذارند و اين بحث در حيطه صلاحيت آنان نيست . و هيچ ارتباط موضوعي با كانون وكلا ندارد ، نهايتا مي توان نقشي براي تدوين قانون وكالت فقط در جنبه مالي مي باشد. ثالثا انجام رايگان برعهده چه كسي است ؟ در صورتيكه قانون گذار مبليغ سي ميليارد ريال براي اين پروژه ملي اختصاص مي دهد ادعاي كانون در انجام رايگان اين امري برچه اساسي استوار است و اگر هدف آنها از بودجه كانون باشد كه بودجه كانون از ماليات اعضا تامين مي گردد وبايد پيشاپيش از وكلا اجازه مي گرفتند.تا بتوانند در چنين پروژه اي ملي هزينه نمايند. كه اين خود اشكال قانوني دارد

براي اولين بار ائتلاف فراگیر جمعی از وكلا و حقوقدانان كه با داشتن كميته هاي تخصصي از رشته دكتراي حقوق علمي تخصصي و مجرب در رشته هاي گوناگون بر خوردار است جلوتر از همه كليات مالي به همراه سر گروههاي متخصص و داراي درجه دكتري را به مجلس معرفي كرد. نظر به اينكه طرح كد گذاري قوانين از تخصص هاي حقوق پارلماني و انتخابات مي باشد كه ائتلاف آقاي دكتر علي حاجي پور كه يكي از از پژوهشگران در حقوق انتخابات با درجه دكترا از دانشگاه اكس مارسي فرانسه مي باشد. تعيين نموده است كه داراي زمينه هاي تخصصي و تحقيقي در داشنگاه فوق مي باشد. كه بي ترديد بحث كد گذاري از موضوعات تخصصي مي باشد كه از عهده ايشان برمي آيد كه در اولين جلسه در كد گذاري 39 گروه كاري ايشان ايرادات موجه گرفته وطي نامه اي در 11 صفحه نظريات ايشان مورخه 12/4/89 به قائم مقام محترم معونت قوانين مجلس و رياست محترم مجلس شوراي اسلامي منعكس گرديده است. اين خود نشانگر تجربيات و تخصص ايشان در موضوع كد گذاري قوانين مي باشد.
